1. This contract is between Scan4Baby Ltd, Company Reg No. 11929530 - t/a First Encounters Ultrasound (FEU) Registered Office Address: 39 Cardiff Road, Llandaff, Cardiff, CF5 2DP and the customer (you) and shall be governed by the following terms and conditions. Nothing in these conditions will affect your statutory rights.
Service Provided
2. FEU will provide foetal imaging ultrasound ("the scan”). Whilst your scan will be conducted by HPC registered qualified obstetric radiographer sonographer’s, it is important to note that we are not in possession of your medical records or history, therefore we cannot provide medical advice or report on diagnostic matters beyond the scope of the evaluations performed during the scan. Information derived from the examination will be supplied in the form of a pregnancy report. In the event we identify matters of concern and it is considered a further detailed diagnostic assessment is required, a referral to your NHS GP/Midwife will be provided in accordance with our approved procedures. Referrals to NHS will only be provided when there is justified concern. The diagnostic evaluations obtained whilst conducting our growth and wellbeing scans provide valuable insight into baby’s continual development and wellbeing, designed to compliment but not replace your NHS Dating/NT (12-14wks) and Anomaly scans (20 wks). Whilst each scan type has a specific purpose, gestation age criteria and defined reporting protocols, our qualified Sonographers have an ethical obligation to highlight, report and refer matters of concern which may be outside the scope/protocols of the performed scan. In some circumstances further NHS evaluation and screening may be required; however the gestation age criteria for such evaluations will be determined by your NHS Antenatal provider.
- The purpose of the EarlyReassure™ is to determine viability observing yolk sac, conduct CRL measurement to date pregnancy, visualise heartbeat and provide reassurance.
- The purpose of the Date&Wellbeing™ to perform growth measurements of HC & FL and well-being checks of visual heartbeat and movement, placental site, fluid volume and position of baby.
- The purpose of the Growth&Wellbeing ™ is to perform growth measurements of HC, AC & FL, and wellbeing checks of visual heartbeat and movement, placental site, fluid volume and position to provide reassurance.
- The purpose of the GenderGrowth&Wellbeing™ is to perform growth measurements of HC, AC & FL, and wellbeing checks of visual heartbeat and movement, placental site, fluid volume and position to provide reassurance and to determine the sex of the baby.
- The purpose of the 4DGrowth&Wellbeing ™ is to perform growth measurements of HC, AC & FL, and wellbeing checks of visual heartbeat and movement, placental site, fluid volume and position to provide reassurance and to determine the sex of the baby. Advanced 3D/4D HDlive imaging software to provide views of baby in an alternative perspective will also be used for parental bonding.
Digital Foetal Assessment Report
3. FEU will supply a printed or an electronic Pregnancy Report detailing the information derived from the examination performed. We would encourage you to share this information with your GP and Midwife.
Souvenir Material & Rescan Guarantee
4. Where applicable FEU will supply a range of souvenir material including and not limited to MP4 video recordings, electronic images on USB and photographic prints of the Scan. You have license to use the souvenir material on the basis that you will not use it for medical reference or for any other purpose other than home use. FEU will not maintain a record of any video recordings. Where applicable, if in our Songrapher’s professional opinion, your baby’s position at the time of the scan prevents either gender determination or the production of relevant suitable 3D/4D souvenir imagery, you will be offered one complimentary rescan on an alternative date. Suitable souvenir 3D/4D imagery is defined as varying unobstructed facial profiles, not limited to face on, combined with imagery of hands and feet where achievable. Images can vary greatly with each pregnancy as such FEU will not warrant the replication of any previous scan imagery the client may wish to make comparison to. The Sonographer’s professional opinion as to the suitability of the imagery obtained is final. In the event the Sonographer determines a rescan is required this decision will be made at the earliest opportunity and the remaining appointment time will be forgone. On the extremely rare occasion we are unable to obtain that which is required after your complimentary rescan, the Sonographer will provide a professional opinion as to whether the desired result would be achievable through further scanning, however any further scan would be chargeable. In the event a complimentary rescan is offered, full payment for the original appointment will be required before any rescan appointment is confirmed. If we are unable to obtain that which is required at a rescan appointment, not withstanding circumstances beyond our control, no refund will be made in relation to any unused scan time, the lack of imagery achieved or failure to confirm gender. If you choose not to elect for a complimentary rescan, or if in the Sonographer’s professional opinion a rescan will not achieve that which is required, the cost of the appropriate souvenirs as defined in the published price list will be refunded.
4dGlimpse™
5. FEU will provide a limited glimpse in 4D motion where the position of the baby is conducive to achieve such imagery. In the event such imagery is not attainable at first glance, no additional time will be spent attempting to obtain images. Failure to provide a 4dGlimpse™ does not constitute reason for a rescan.
Price & Payment Terms
6. The price for the scan will be the price stipulated at the time of booking. Scan services are exempt from VAT as defined under VAT Notice 701/57 Paragraph 2.1.
7. Reservations can be made by phone or by using our secure on-line booking facility. A non refundable deposit of £25 is required on credit /debit card at the time of booking to secure an appointment.
8. Balance Payments shall be made in advance of a scheduled appointment as defined within the Appointment Confirmation email. Failure to settle outstanding payments within defined time frame will result in automatic cancellation of a scheduled appointment.
Cancellation & Amendment Terms
9. A confirmed booking is an appointment for which a deposit has been paid. Should you wish to cancel or amend your appointment the following terms apply:-
a) Cancellation of a confirmed appointment up to 48 hours prior to scheduled appointment will be subject to a cancellation fee of £25 being the value of the deposit paid.
b) Amendments to a confirmed appointment up to 48 hours prior to scheduled appointment will not be subject to any amendment fee for the first amendment, however further amendments will be subject to an amendment fee of £25.
c) Failed attendance or cancellation of a confirmed appointment within 48 hours of a scheduled appointment will be subject to the full outstanding balance of the chosen scan package, less the cost of any additional souvenirs added, being debited from the card from which the deposit was paid.
d) Amendments to a confirmed appointment within 48 hours of a scheduled appointment will be subject to an amendment fee of £25 being added to the outstanding balance, full payment of which must be paid at the time of amendment.

Safeguarding of Minors
11. FEU has adopted an ethical policy to restrict services provided to those aged 16 years and over.
Miscellaneous
12. Scan bookings are allotted a specific time slot. Whilst every effort is made to ensure the Scan is carried out at the allocated time, appointment times cannot be guaranteed.
13. FEU accepts no responsibility for any loss or damage to personal effects howsoever caused whilst customers are on the premises.
14. FEU reserves the right to modify the service without notice from time to time. If, by doing so, the service is materially different then you will have the right to cancellation.
15. FEU will not be responsible or liable for any incidental or consequential loss or damage:
a) Caused by any act or omission by First Encounters or its employees or agents.
b) Suffered by any person acting or failing to act as a result of the contents of any scan or any information supplied in connection with the Scan. Nothing in this clause shall exclude or restrict any liability for death or personal injury arising from the negligence of FEU.
16. FEU will not be responsible for the breach of this contract caused by circumstances beyond its reasonable control.
17. This contract is governed by the laws of England and Wales and is the entire contract between you and FEU.
